Data Collection and User Access

Minigem collects your username and email address solely for the purpose of identifying your user status. This data is used to manage your access to optional, enhanced "bonus features" which can be activated through your voluntary support or engagement with affiliate offers.

App Functionality and Web Scraping

Minigem's core functionality relies on actively "web scraping" content from the Gemini website to provide its "Minigems" (prompt shortcuts, conversational memory, navigation, and code utilities).
You acknowledge and agree that this "web scraping" is an inherent and necessary function of the extension.

Site Compatibility, Updates, and Feature Longevity

Minigem is designed to enhance the Gemini chat interface by "hooking its UI elements" into the existing Gemini website structure.
You understand and accept that if Google updates the Gemini website, the functionality of Minigem may be temporarily disrupted.
We will endeavour to update and "hook our UI elements" back into the Gemini interface as quickly as possible; however, you agree to be patient during such periods, as this process "could take a little while."
Furthermore, as Gemini continues to evolve, our features may also become redundant. It may not always be possible to attach our elements to Gemini. You acknowledge that this outcome is entirely dependent on Google's product updates and is beyond our control.

Google Compliance

Minigem operates as a Chrome Extension and adheres to the policies and guidelines set forth by Google for the Chrome Web Store. This includes, but is not limited to, policies regarding user privacy, data handling, security, and advertising practices. We strive to maintain full compliance to ensure a safe and reliable experience for all users and to operate within Google's ecosystem standards.

Nature of Service and Limitation of Liability

Minigem is provided as a free-to-use browser extension with optional bonus features.
You understand and agree that Minigem does not sell any digital products or services in the traditional sense, nor do you purchase or subscribe to any features. Your access to bonus features is granted as a token of appreciation for your voluntary support (e.g., "Buy us a Coffee") or through your engagement with affiliate offers.
You use Minigem at your own risk. We shall not be held responsible for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the extension, including but not limited to, issues stemming from its "web scraping" activities or compatibility disruptions due to website updates, except where such liability cannot be excluded or limited by law.
You agree not to seek any "comeback" or liability against us simply because the app "does actively scrape content off the Gemini page and that is its function" unless this scraping function renders the app not of satisfactory quality, fit for purpose, or as described in a manner that falls within consumer protection laws.

Bonus Features and Monetization

Minigem offers certain "bonus features" (such as the ability to import, export, add, delete, and edit Premade Minigems, or create extra user-made prompts) which enhance the core functionality of the free extension. Access to these bonus features is provided through:

• Voluntary Contribution: By making a one-time "Buy me a Coffee" contribution, you receive a specific set of bonus features as a gesture of appreciation for your support. This is a voluntary gift and does not constitute a purchase of a product or service.
• Affiliate Engagement: By engaging with our selected affiliate advertisers (e.g., by clicking an affiliate link to earn bonus points), you can also activate temporary access to certain bonus features. This helps support the app's development.

You acknowledge that the availability and functionality of these bonus features, like the core app, are entirely dependent on Google Gemini's web interface and may be subject to disruption or removal without liability on our part, consistent with the "as is" nature of the service.

Affiliate Partnerships (For Advertisers and Publishers)

Minigem offers advertisers an opportunity to reach its highly engaged, AI-focused user base. Our primary model for direct partnerships is through affiliate engagement, where users voluntarily click the Minigem affiliates link in exchange for in-app bonus rewards (such as points towards creating extra user-made prompts or activating other bonus features).

• Management Platform: All our affiliate relationships and payment management are handled transparently through Awin.com, a leading global affiliate marketing platform that empowers advertisers and publishers of all sizes.
• App Limitations for Partners: Prospective partners are strongly advised to review and understand the inherent limitations of Minigem's functionality, as detailed in Section 3 (Site Compatibility, Updates, and Feature Longevity). Our app's core operation relies on active "web scraping" of the Gemini website, meaning its functionality can be temporarily disrupted or features may become redundant due to Google's updates, which are beyond our control. Partners acknowledge and accept this dependency when engaging in promotional activities with Minigem.

No Warranties

Minigem is provided on an 'as is' and 'as available' basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except for any warranties that cannot be excluded or limited under applicable law, such as your statutory rights as a consumer under the Consumer Rights Act 2015 regarding digital content.
We do not warrant that the extension will be uninterrupted, error-free, or compatible with all versions or future versions of the Gemini website, except to the extent required by law where such lack of warranty would render the free digital content (e.g., the core app, or bonus features provided) not of satisfactory quality, fit for purpose, or as described.

Indemnification

You agree to indemnify, defend, and hold harmless Minigem, its affiliates, officers, directors, employees, consultants, and agents from any and all third-party claims, liability, damages, and costs (including, but not limited to, reasonable legal fees) arising from your use of Minigem, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity, except where such claims arise directly from our breach of these Terms or our legal obligations.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles.
Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Intellectual Property Rights

All intellectual property rights in Minigem, including all source code, software, designs, text, graphics, and other content, are owned by Minigem or its licensors.
Your use of Minigem does not grant you any ownership rights to the extension.

Termination

We reserve the right to suspend or terminate your access to Minigem at our sole discretion, without notice, for any reason, including but not limited to, a breach of these Terms and Conditions.

Severability

If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Entire Agreement

These Terms and Conditions constitute the entire agreement between you and Minigem regarding the use of Minigem, and supersede all prior or contemporaneous understandings and agreements, whether written or oral, regarding such subject matter.
